Members considered an application by Mr Lee Hopwood-Robinson to vary a premises licence at the Churchill Hotel, Bootham, York.
Members were presented with the following options:
Option 1 Grant the variation of the premises licence in the terms applied for
Option 2 Grant the variation of the premises licence with modified/additional conditions imposed by the licensing committee
Option 3 Grant the variation of the premises licence to exclude any of the licensable activities to which the application relates and modify/add conditions accordingly
Option 4 Reject the application
Officers updated that the representation received from the North Yorkshire Fire Authority had been withdrawn after successful mediation.
Representations were received from the applicant both in writing and at the Hearing. He was willing to negotiate with neighbours regarding any noise issues that may arise and he clarified that he intended to put up clear signage requesting patrons to give consideration to local residents when outside of the hotel building.
Members agreed that the application should be varied to include the provision of late night refreshment.
Taking into consideration, the representations made in writing and at the Hearing, the Licensing Objectives and the City of York Council’s Statement of Licensing Policy, the Sub-Committee agreed to grant the variation of the premises licence with additional conditions.
RESOLVED: That, in line with the above Option 2, the variation of the premises licence with the additional conditions listed below, be granted.
1. The provision of late night refreshment will be from 23:00 hours to 01:00 hours on each and every day
2. The occupancy figure for the new function room should not exceed 100 persons
INFORMATIVE
The panel requested that any CCTV installed be recordable and the recordings held for 28 days.
REASON: To address the representations made in respect of public nuisance.
