Members considered an application by Inventive Leisure Services Ltd for an Application for a Premises Licence in respect of Revolution, Coney Street, York, YO1 9QL.
In coming to their decision the Sub-committee took into consideration all the evidence and submissions that were presented and determined their relevance to the issues raised and the licensing objective, the prevention of public nuisance, including:
- The application form, and the additional steps agreed to be taken by the applicant to promote the four licensing objectives.
- The Licensing Officer’s report and his comments made at the Hearing
- The Applicant’s representations at the Hearing, including the 14 years experience of running licensed premises Inventive Leisure have and their willingness to work with their neighbours. Inventive Leisure also stated that they were looking at various ways of reducing noise emanating from the premises including the possibility of installing buffering systems to the roof/ceiling.
- The representations made by the City Screen Cinema in writing and at the Hearing. The Sub-Committee considered both the written and verbal representations to be relevant to the issues raised and the licensing objective listed above. The representor’s main concerns were noise and vibrations emanating from the premises and disturbance watching films in the above screens.
The representations made by the North Yorkshire Police were withdrawn prior to the Hearing.
The Sub-Committee agreed to grant the variation of the premises licence with the following conditions:
- Mandatory conditions set out in Sub-Sections 19, 20 and 21 of the Licensing Act 2003.
- That the Premises Licence Holder be required to join the Pub Watch scheme
- That the balcony area be closed for licensable activities and cleared by 23:00 hours each and every day.
- That no nuisance be caused to adjoining occupiers emanating from the premises.
All conditions offered by the Applicant in the application, including the operating schedule, for granting the premises licence under the Licensing Act 2003, shall be included in the licence, unless contradictory to the above conditions.
