It was reported that there had been seven registrations to speak under the Council’s scheme of public participation. It was explained that speakers would be taken under the appropriate items of business on the agenda.

Tony Fisher, a resident of Stockton on the Forest, presented a petition of 172 signatures calling for a left filter lane on the junction between Hopton Lane South and Malton Road. He reported that the majority of traffic at the junction turned left towards town and that the filter lane would take pressure off traffic turning right.

The executive member received the petition for his consideration.

This report sets out the formal objections received within the legal advertising period to the proposed extension of three separate Residents’ Priority Parking Schemes and requests an agreement to take forward the recommended option for each area.

Resolved:  To implement the advertised proposals to amend the York Parking, Stopping and Waiting Traffic Regulation Order to extend three existing Residents Priority Parking Areas to include the following:

i.             South Bank Avenue within R57C

ii.            St Aubyn’s Place within R59

iii.           Bishopthorpe Road area within R58C with an amendment to the advertised boundary and with a view to carrying out a formal consultation with further residents on Bishopthorpe Road (part) after the agreed amended scheme has been implemented. The extent of properties will be in agreement with the Executive Member for Transport and Planning.

Reason:     To progress the majority views of residents consulted and to take into account the second petition received to exclude part of Bishopthorpe Road.

The Executive Member considered a report on a proposal to extend the following three existing Resident Priority Parking Areas:

·        South Bank Avenue within R57C

·        St Aubyn’s Place within R59

·        Bishopthorpe Road area within R58C

South Bank Avenue

Tony Piper, a resident of South Bank Avenue, presented the results of a resident survey which suggested those living at the top end of the street were opposed to the parking scheme. He asked that this part of the street was excluded from the proposal.

The officer reported that this would be possible but would be likely to cause a displacement of parked cars. Option one (to implement the scheme) was approved. Option two (to implement a separate scheme) and Option three (to take no action) were rejected because they did not meet the needs of residents and would not effectively improve parking arrangements.

St Aubyn’s Place

Peter Cook, as lead petitioner, reported that the proposed scheme was required as the street was routinely used for parking by shoppers, commuters and local trades people and that irresponsible parking routinely led to damage of vehicles.

The Chair reported that there was ongoing communication with North Yorkshire Police about approaches to preventing cars from being parking on pavements. Option one (to implement the scheme) was approved. Option two (to implement a separate scheme) was rejected because it would delay the implementation of the scheme and would not provide sufficient flexibility for resident parking.

Bishopthorpe Road area

Jenny Dunning, a resident of Bishopthorpe Road, reported that the proposal to restrict parking on only one side of Bishopthorpe Road would further increase problem parking on the unrestricted side, and asked that residents of this later side of the road be consulted before implementing the scheme.

The officer reported that the houses in question had been excluded following consultation but that Option Two of the report would enable both sides of Bishopthorpe Road to be excluded and (if required) added in at a later stage after further consultation had been undertaken. This option was approved. Option One (to implement the scheme as advertised), Option Three (to delay implementation of the whole scheme to allow for further consultation) and Option four (to take no further action) were rejected as they would not meet the needs of residents or would delay implementation of the scheme.

This reports sets out the objections received within the legal consultation period to the advertised proposal to amend the Traffic Regulation Order to include Residents’ Priority Parking in the Holgate Ward for (Holgate Central) and requests a decision from the options given.

Resolved:  To approve the implementation of the advertised proposal to amend the York Parking, Stopping and Waiting Traffic Regulation Order to introduce a Residents’ Priority Parking Area in Holgate Central, with a concession for the property on Enfield Crescent (private street) as outlined in Annex C of the report.

Reason:     To progress the majority views of the residents consulted and to take into consideration the needs of the schools and churches in the area.

The Executive Member considered a proposal for a Residents’ Priority Parking Scheme in Holgate Central.

Philip Hunter, representing the Spiritualist Centre, asked that the proposed scheme be restricted to between 9am and 5pm to enable public parking during evening services.

Francesca Glyn-Jones, a resident of Enfield Crescent, explained the exceptional circumstances regarding parking arrangements for her property and asked that residents of the property be entitled to a parking permit.

The officer confirmed that there were exceptional circumstances regarding the property on Enfield Crescent but that it was not practical to include the property within the Traffic Regulation Order (TRO). He therefore proposed the use of an existing delegated power within the TRO to issue a permit to the property. He also explained that exceptions were already in place for funeral and wedding cars and that, if given advance notice, the parking team would be made aware.

Option one (to implement the scheme) was approved.

Resolved:  To approve the implementation of the advertised proposal to amend the York Parking, Stopping and Waiting Traffic Regulation Order to introduce a Residents’ Priority Parking Area in the Holgate Ward, with a concession for the property on Enfield Crescent (private street) as outlined in Annex C of the report.

Resolved:  To authorise entry into a Creation Agreement with landowners to create a section of public bridleway between Metcalf Lane and Meadlands, Derwenthorpe, Osbaldwick.

Reason:     The outstanding objection to the original Diversion Order has been withdrawn on condition that officers are instructed to enter into a Creation Agreement. The withdrawal of the objection allows the Diversion Order to be confirmed meaning work on the two dwellings affected by the Order can recommence.

The Executive Member considered a report that sought authorisation to enter into a Creation Agreement with landowners to create a section of public bridleway between Metcalf Lane and Meadlands, Derwenthorpe, Osbaldwick. This was considered as an urgent item in order to allow the proposed Diversion Order to be confirmed and work on the two dwellings affected by the Order to recommence.

Paul Walton, resident, asked that his thanks be noted for the withdrawal of the objection which had enabled the build to go ahead and to the officers of the council responsible for identifying alternative options which would allow all parties to be satisfied.

The Chair thanked Mr Walton for his comments and reported that it had been an awkward situation but that he was glad that a suitable resolution had been found. Option one (to authorise the Creation Agreement) was approved.
