The Determination of an Application by City of York Council, Communities and Culture to Vary a Premises Licence Section 35(3)(a) in respect of Rowntree Park, Terry Avenue, York. (CYC- 011301) pdf icon PDF 109 KB

Minutes:

Members considered an application by City of York Council Communities and Culture to Vary a Premises Licence in respect of Rowntree Park, York.

 

In coming to their decision the sub-committee took into consideration all of the evidence and submissions that were presented to them and determined their relevance to the issues raised and the licensing objectives.  The following were taken into account:

 

1.   The application form.

 

2.   The Licensing Managers report and her comments made at the Hearing. She advised that the application was to vary a premises licence and that prior to the application being submitted; the Councils Environmental Protection Unit had been consulted and had agreed conditions to be included on the operating schedule to assist in the control of noise. It was confirmed that there had been no representations from any of the responsible authorities and that the consultation process had been carried out correctly.

 

3.   The Council’s representations made at the hearing. The Officer advised that the Council had applied for licence variations for all existing park licences in order to update the operating schedules. Due to work carried out alongside the Environmental Protection Unit, the Council were confident that noise nuisance would be minimal. The application for an increase in hours was to ensure that event organisers are responsible for noise control until 22:00, although due to a lack of lighting at the park, most events would terminate by dusk.

 

4.   The representations made by local residents in writing. They raised concerns regarding the potential for noise nuisance and the increase in hours that the park will be licensed for regulated entertainment.

The Sub-Committee were presented with the following options:

 

Option 1     Grant the licence in the terms applied for.

 

Option 2     Grant the licence with modified/additional conditions imposed by the licensing committee.

 

Option 3     Grant the licence to exclude any of the licensable activities to which the application relates and modify/add conditions accordingly.

 

Option 4     Reject the application.

 

The Sub-Committee chose Option 1 and granted the licence in the terms applied for. All mandatory conditions will apply.

 

RESOLVED:                That in line with Option 1, the licence be granted in the terms applied for.

 

REASON:                     The Sub Committee were satisfied with the application and saw no reason to amend or modify it.
