Minutes: Members considered an application by Mitchells and Butlers Leisure Limited for a Premises Licence in respect of Harvester, Clifton Moor, York.
In coming to their decision the sub-committee took into consideration all of the evidence and submissions that were presented to them and determined their relevance to the issues raised and the licensing objective public nuisance. The following were taken into account:
1. The application form.
2. The Licensing Officer’s report and her comments made at the Hearing. The plans were clarified and the correct ones put before the Committee. The application was for the grant of a new licence and the premises would open until midnight. The Officer advised that the Police had agreed conditions with the applicant and that there were 3 other interested parties.
3. The applicants representations at the hearing. Members were advised that the premises would be a new retail Harvester that are specifically aimed at retail parks , there would be no bar within it and it is a restaurant style operation. The applicant had withdrawn non-standard timings apart from New Years Eve and had accepted the Police conditions.
4. The representations made by Rawcliffe Parish Council in writing and at the hearing. The representations were considered valid as concerns were raised about Public Nuisance due to the potential for people being in the area late at night and the fact that the operating schedule had not been filled in correctly to show how the applicant would address any issues that may arise.
5. Written representations made within the consultation period.
Members were presented with the following options:
Option 1 Grant the licence in the terms applied for.
Option 2 Grant the licence with modified/additional conditions imposed by the licensing committee.
Option 3 Grant the licence to exclude any of the licensable activities to which the application relates and modify/add conditions accordingly.
Option 4 Reject the application.
Members chose Option 2 and added the following conditions to the licence.
1. Copies of CCTV recordings will display the correct time and date of the recording. 2. Off sales shall be made in sealed containers (save for those sales specifically for consumption in any outside drinking areas attached to the premises). 3. The outside area shall be closed at 10pm on each and every day. 4. Contact details of the Duty Manager shall be made available to local residents upon request. 5. The hours the premises are open to the public shall be 10:00 to 00:30 on each and every day with the exception of New Years Eve when the premises can remain open from the end of permitted hours on New Years Eve to the start of permitted hours on New Years Day. Mandatory conditions 19 and 20 shall apply.
REASON: That in line with Option 2 the licence be granted.
REASON: To address the representations made.
