Members considered an application by Mr. Murat Bulut for the variation of a premises licence in respect of SaltN’Pepper, 19 Tanner Row, York.

 

In coming to their decision the Sub-Committee took into consideration all of the evidence and submissions that were presented and determined their relevance to the issues raised and the licensing objectives; the prevention of crime and disorder and the prevention of public nuisance.

 

  1. The application form, in particular the existing licence conditions and the steps currently being taken to promote the four licensing objectives.

 

  1. The Licensing Officer’s report and his comments made at the hearing. This included the fact that the applicant does not propose any further measures to promote the four licensing objectives as the current licence is subject to 7 additional conditions. He stated that there had been no representations received from the Police or Fire Authorities and that the premises were in the Cumulative Impact Zone.

 

  1. The Applicant’s representations at the hearing, included the fact that there had been no complaints from the Police. The Applicant highlighted that there was security staff on duty during licensable hours and a CCTV system in operation.

 

  1. A Local Residents representation both in writing and at the hearing. The Resident expressed concerns that licensed premises in the area are opening later and it is difficult for the police and premises staff to encourage people to vacate the area quickly and quietly.

 

  1. Written representations made during the consultation period.

 

Members were presented with the following options:

 

Option 1        Grant the variation of the licence in the terms applied for.

 

Option 2        Grant the variation of the licence with modified/additional conditions imposed by the licensing committee.

 

Option 3        Grant the variation of the licence to exclude any of the licensable activities to which the licence relates and modify/add conditions accordingly.

 

Option 4        Reject the application.

 

RESOLVED              That in line with Option 2 the variation to the licence be granted.

 

In coming to their decision of approving Option 2, the Sub-Committee then imposed the following modified conditions:

 

  1. Door Supervision shall be provided on site during the licensing period on each and every day.

 

 

  1. CCTV shall be maintained and in operation during opening hours on each and every day, and shall be available to Responsible Authorities on request.

 

 

  1. There shall be a litter pick in the nearby vicinity of the premises at the end of the licensing period on each and every day.

 

 

  1. A member of staff shall be identifiable as Duty Manager on each and every day.

 

 

  1. Mandatory Condition 21 (Door Supervision), shall apply.

 

 

REASON:                  To address the representation made in respect of the prevention of crime and disorder and public nuisance.
