Members considered an application by City of York Council’s Learning, Culture and Children’s Services Directorate for a Premises Licence in relation to Woodthorpe Primary School, Summerfield Road, York, YO24 2RU.

 

The Licensing Officer reported that this application did not include alcohol and there would be no change to the type of activities being held at the school. The Officer confirmed that Section H (relating to similar activities to live music, recorded music and performance of dance) was not being applied for. He also confirmed that one of the representations had been withdrawn prior to the Hearing.

 

Representations were received from the Applicant at the Hearing who said the school was not seeking to hold additional activities or change the type of activities held.

 

Written representations had been received during the consultation period.

 

Members were presented with the following options:

 

Option 1                    Grant the licence in the terms applied for.

 

Option 2                    Grant the licence with modified/additional conditions imposed by the licensing committee.

 

Option 3                    Grant the licence to exclude any of the licensable activities to which the application related and modify/add conditions accordingly.

 

Option 4                    Reject the application.

 

Taking into consideration the representations made in writing and at the hearing, the licensing objectives and the City of York Council’s Statement of Licensing Policy, the Sub-Committee agreed to grant the premises licence with the following additional and mandatory conditions:

 

RESOLVED:             That in line with Option 2, the premises licence be granted with the following additional conditions:

 

1.      The maximum occupancy for the various rooms should not exceed the following numbers when used for dancing with a group, disco, or similar activity.

Key Stage 1 Hall – 100 persons

Key Stage 2 Hall – 364 persons

 

2.      When a performance takes place before a seated audience, no seating should be more than 7 seats from a gangway; any temporary seating should be secured in lengths no fewer than 4 seats and no more than 12. The minimum width of any gangway should be 1.05m.

 

3.      An occupancy figure for a seated audience should be reduced accordingly, dependent on the size of any stage and the layout of the seating taking into account any gangways.

 

4.      Regulated entertainment will only occur between 08:00 hours and 21:30 hours.

 

5.      The nature and character of activities and events will not change from school related activities.

 

6.      No regulated entertainment shall occur outside of the infant hall (Key Stage 1 Hall) or the junior hall (Key Stage 2 Hall).

 

7.      Mandatory conditions 20 and 22 apply.

 

REASON:                  To address the representations made in respect of the prevention of public nuisance.
