Members considered an application by Mr Sukuru Akgull for a premises licence in respect of Pizza Box, 57 The Village, Haxby, York.

 

Members were presented with the following options:

 

Option 1        Grant the licence in the terms applied for

Option 2        Grant the licence with modified/additional conditions imposed by the licensing committee

Option 3        Grant the licence to exclude any of the licensable activities to which the application relates and modify/add conditions accordingly

Option 4        Reject the application

 

The Officer confirmed that the Applicant had a Designated Premises Supervisor Certificate. He said that there were no facilities for eating and drinking on the premises and the application was for off-sales only.

 

Representations were received from the Applicant at the Hearing. He confirmed that he would only be selling wines and beers and did not want to sell alcohol on the premises. He would only sell alcohol with food orders and would check people’s identification when delivering.

 

Taking into consideration the representations made in writing and at the Hearing, the Licensing Objectives and the City of York Council’s Statement of Licensing Policy, the Sub-Committee agreed to grant the premises licence with mandatory and additional conditions.

 

RESOLVED:             That, in line with the above Option 2, the premises licence with the mandatory and additional conditions listed below be granted.

 

1.      Mandatory condition 19 applies

2.      All delivery staff must be at least 18 years of age

3.      All deliveries must be completed by 23:00 hours

4.      Alcohol shall only be sold ancillary to the ordering and delivering of take-away food

5.      All deliveries must be made to a recognised postal address

6.      Proof of Age Identification of the recipient must be checked on delivery of alcohol

 

REASON:      To address the representations made in respect of the prevention of crime and disorder and public nuisance.
