To elect a Member to act as Chair of the meeting.

RESOLVED:             That Councillor Nimmo be elected to act as Chair of the meeting.

At this point Members are asked to declare any personal or prejudicial interests they may have in the business on this agenda.

Members were invited to declare any personal or prejudicial interests in any of the business on the agenda. None were declared.

To consider excluding the public and press from the meeting prior to consideration of the personal data contained in annexe 5 to Agenda Item 5 as provided by the Data Protection Act 1998.

RESOLVED:             That the press and public be excluded from the meeting prior to  consideration of the personal data contained in annex 5 to agenda item 5 as provided by the Data Protection act 1998.

Members considered an application by Mr and Mrs Stanton for a Review of the Premises Licence in respect of the Bay Horse, Main Street, Fulford, York, YO10 4PW.

In considering the application and the representations made the Sub-Committee concluded that the following licensing objective was relevant to this Hearing:

• Prevention of Public Nuisance

In coming to their decision, the Sub-Committee took into consideration all the evidence and submissions that were presented and determined their relevance to the issues raised and the above licensing objective, including:

1. The application form, in particular the existing licence conditions and the steps taken by the applicant to promote the four licensing objectives.

2. The Licensing Officer’s report and the comments he had on the written representations made by the applicant.

3. The Applicant’s written representations at the Hearing.

4. The representations of the holder of the premises licence made at the Hearing.

Having regard to the application and any relevant representations, the Sub-Committee had to determine whether to take any of the steps mentioned under Section 52(4) that it considered necessary for the promotion of the licensing objectives. Taking into consideration the above evidence and submissions received, the Sub-Committee decided to dismiss the Application for Review on the ground that the evidence produced did not justify the Sub-Committee making any other decision in respect of the licence.
