Members considered an application by Mr Christopher Leslie Fall to vary a premises licence at Rumours, 94 Micklegate, York.

 

In coming to their decision the Sub-Committee took into consideration all the evidence and submissions that were presented and determined their relevance to the issues raised and the licensing objective, the prevention of public nuisance, including:

 

  1. The application form, in particular the existing licence conditions and the additional steps agreed to be taken by the Applicant to promote the four licensing objectives.
  2. The Licensing Officer’s report and his comments made at the Hearing including that the premises were in the special policy area.
  3. The representations made in writing by the Environmental Protection Unit and at the Hearing including a recommendation that conditions be attached to the licence regarding the prevention of noise nuisance.
  4. The representations made at the Hearing and extra papers submitted after the agenda had been published by the Applicant’s solicitor including that the Applicant was prepared to concede that the outdoor music should finish at 00:00 hours.
  5. The written representations made during the consultation period.

 

The Sub-Committee agreed to grant the variation of the premises licence with the following conditions:

  • To extend the time when recorded music is allowed from Monday to Sunday 10:00 to 00:30 in line with the supply of alcohol
  • After 23:00 all external speakers shall be used for background music only and be switched off at midnight.
  • Noise emanating from any part of the premises after 23:00 must be inaudible at the nearest noise sensitive façade.
  • The self-closing doors both to the front and the rear of the building must remain closed at all times except for providing means of ingress and egress.
