/members considered an application by Wigginton Parochial Church Council for a premises licence at St Mary & St Nicholas Parish Church (Wigginton Parish Church), Back Lane, Wigginton, York, YO32 2ZH.

 

In coming to their decision the Sub-Committee took into consideration all the evidence and submissions that were presented and determined their relevance to the issues raised and the licensing objective, the prevention of public nuisance, including:

 

  1. The application form, in particular the additional steps agreed to be taken by the Applicant to promote the four licensing objectives.
  2. The Licensing Officer’s report and his comments made at the Hearing including stressing that the Act sought to promote community activities.
  3. The Applicant’s representations at the Hearing, including the fact that they will make noise level checks at regular intervals.
  4. The representations made by a local resident in writing regarding public nuisance and excessive noise levels. The Sub-Committee considered the representation made was not relevant because it was aspirational.

 

Representations made by North Yorkshire Fire and Rescue Service regarding occupancy levels were withdrawn prior to the Hearing.

 

The Sub-Committee agreed to grant the premises licence with the following conditions:

 

  • The only point of sale for alcohol will be the Church Hall.
  • Mandatory Conditions 18, 19, 20 and 22 apply.

 

All conditions offered by the Applicant in the application, including the operating schedule, for granting the premises licence under the Licensing Act 2003, shall be included in the licence, unless contradictory to the above conditions.
