Decision Maker: Decision Session - Executive Member for Environment and Climate Emergency, Executive Member for Environment

Decision status: Decision Made

Is Key decision?: No

Is subject to call in?: Yes

Purpose:

Purpose of Report: Local Authorities have a statutory duty to implement and enforce contaminated land legislation (Part 2A of the Environmental Protection Act 1990) in order to protect human health and the environment, and we are required to outline our approach in a written strategy.

City of York Council’s first contaminated land strategy was published in July 2001 with subsequent updates in 2005, 2010 and 2016. This 2016 version incorporates recent changes in legislation and guidance and provides an update on progress made to date.

The Executive Member for the Environment is asked to approve the adoption and publication of the updated contaminated land strategy.

Decision:

Resolved:  That the updated contaminated land strategy be approved and a review be undertaken at least every five years.

Reason:  This will fulfil the council’s legal duties to update the contaminated land strategy and to inspect potentially contaminated sites.
