Purpose:

Purpose of Report: To inform Cabinet of the recent changes made to the Licensing Act 2003, following the implementation of Section 119 (Early Morning Restriction Orders) and Chapter 2 (Late Night Levy) of the Police Reform and Social Responsibility Act 2011 (2011 Act), on 31 October 2012 and the potential impact on the Licensing Authority.

Members are asked to advise officers if they want the authority to look into adopting either the late night levy or early morning restriction orders or both.

 

This report was slipped to a January decision because the draft report had not been seen by the Cabinet Member in time. The Cabinet Member will now consider the report in February to allow more time for further consultation. The report will now be considered by the Cabinet Member during March as further changes are required to the report.

This report will now be considered by full Cabinet at its meeting in May due to the nature of the decision.

Decision:

RESOLVED:       That Cabinet approve Option 1, as set out at Para 18 of the report, to consult with North Yorkshire Police, the Police and Crime Commissioner, other responsible authorities, Safer York Partnership and the relevant Business Community with regards to the introduction of Early Morning Restriction Orders and/or the Levy.

 

REASON:           To ensure that the council have the appropriate evidence to consider the introduction of EMROs or a Late Night Levy.
