Decision:
The Local Plan was adopted by Full Council on
27 February 2025. This now forms part of the development plan for
the city.
Regulation 26 of the Town and Country Planning Regulations
states:
26.??As soon as reasonably practicable after the local planning
authority adopt a local plan they must—
(a)make available in accordance with regulation?35—
(i)the local plan;
(ii)an adoption statement;
(iii)the sustainability appraisal report; and
(iv)details of where the local plan is available for inspection and
the places and times at which the document can be inspected;
(b)send a copy of the adoption statement to any person who has
asked to be notified of the adoption of the local plan; and
(c)send a copy of the adoption statement to the Secretary of
State.
Full Council resolved to delegate authority to the Director of City
Development for:
• publishing the Local Plan, agreeing any further non-material
minor corrections and factual updates and publishing of the adopted
Local Plan and Policies Map;
• Agreeing correspondence relating to adoption including the
adoption statement, Sustainability Appraisal Report and
communications regarding the plan in accordance with Regulation 26
of the Town and Country Planning Act 2012 (as amended).
This decision is to publish the following documents:
The adopted Local Plan, incorporating the schedule of Main
Modifications provided by the Inspectors (Annex A to their report)
and further non-material minor corrections and factual
updates.
The majority of updates included in the schedule of further
non-material minor corrections and updates were consulted on
alongside the Main Modifications consultation in February/March
2023. Additional factual corrections have been included where
necessary to ensure the Local Plan is grammatically correct having
incorporated the
Main Modifications.
• The Sustainability Appraisal Report – this sets out
how the plan is likely to achieve sustainable development
objectives.
• Adoption statement – this sets out when the plan was
adopted, how to view the adopted plan and how to apply to challenge
the plan by applying to the High Court in accordance with the
Section 113 of the Planning ad Compulsory Purchase Act 2004. The
period for applying to challenge the decision is 6 weeks and runs:
27 February to 11 April 2025.
• Draft notification correspondence – this is to be sent
to all interested parties who have asked to be kept up to-date of
the Local Plan process.
The Policies Map is under development and will be subject to a
separate decision for publishing.
Background
The new Local Plan was submitted for independent Examination in May
2018. Two inspectors were appointed by the Secretary of State who
undertook 5 phases of examination between 2019-2024. The inspectors
issued their final report on 14 February 2025. As part of their
conclusions, the inspectors recommended Main Modifications to the
plan to enable it to be made ‘sound’ and capable of
adoption.
A decision was made by Full Council to: Adopt the Local Plan with
main modification and additional modifications (to be delegated to
the Director for City Development). Consequently, the Local Plan
adoption version and accompanying statutory documents must now be
published.
