Decision details

Proposal to mutually terminate the lease for Askham Bar nursery

Decision Maker: Decision Session - Executive Member for Finance and Major Projects, Executive Member for Finance and Performance

Decision status: Decision Made

Is Key decision?: No

Is subject to call in?: Yes

Purpose:

Purpose of Report: The report sets out a proposal to mutually agree the termination of the lease for the Askham Bar nursery facility due to the closure of the adjoining Park and Ride and subsequent plans to redevelop the site.

What will the report ask the Executive Member to do: Approve the termination of the lease for Askham Bar nursery to facilitate the development by the council of the adjoining site for the delivery of housing.

The Council aims to give the same 28 days notice of non-key decisions, as it does for key decisions, but in exceptional circumstances this may not be possible. In this case, it has not been possible as the leasee wishes to terminate the lease at the end of August in order to provide certainty to her customers for the next nursery term.

Decision:

Resolved: That agreement be given to end the lease at Askham Bar Nursery by way of a lease surrender with a compensation payment of £35,000 being paid to the tenant.

Reason:     This will enable the wider redevelopment of the former park and ride site which is allocated for housing allocation in the Draft Local Plan.
