Background

In July 2022, the Executive approved a consultation on the proposed ‘City of York Guidance and Conditions for Pavement Cafes’, with a report be brought to Executive in November 2022 on the outcome of the consultation (with the updated guidance taking effect in January 2023 if approved). As all temporary pavement café licences expire automatically on 30 September 2022, licence holders have been applying to renew their licences, for an initial period of three months (under the existing guidance). They will need to apply again in December 2022, under the updated guidance.

A review of the licence applications received in August and September 2022 has identified the issue of the current lack of dropped kerbs in some city centre streets, which would result in restricted access for wheelchair and mobility aid users and any other users who may need a ramp to access the footway, if a licence were to be granted without any mitigation measures.

It is therefore proposed to trial the inclusion of temporary accessible kerb ramps (similar to the image below) within the furniture which can be licensed as part of a pavement café area, where these are required in the city centre. The trial will start in October 2022 and end in December 2022 (as the guidance will then have been updated).

Where such a ramp is included in a pavement café licence, the licence holder will be required to install the ramp according to manufacturer’s instructions at the start of the licensed period, check the ramp regularly during the day, and remove the ramp at the end of the licensed period. The ramps will be compliant with the requirements set out in Inclusive Mobility (see end of Section 5.2 – available here: https://www.gov.uk/government/publications/inclusive-mobility-making-transport-accessible-for-passengers-and-pedestrians).

During the trial period, the ramps and cones will be provided by City of York Council free of charge although the licence holder will be asked to replace any missing or damaged ramps or cones at their own cost.

Ramps will need to be installed within the pavement café area (adjacent to the licensed premises) unless the licence holder has obtained permission from the neighbouring landowners to place the ramp in front of their premises.

The use of the temporary ramps will then be reviewed through the consultation on the proposed ‘City of York Guidance and Conditions for Pavement Cafes’.
