Background / Decision Summary:
The need for the provision of Independent Persons (IP), Independent Investigating Officers (IIO) and Independent Stage 3 Panelists and Chairs, is to meet our statutory obligations under The Children Act 1989 Representations Procedure (England) Regulations 2006, in relation to the investigation of Childrens Social Care complaints and the provider helps us to meet these statutory obligations. We also include the requirement that on some occasions, that the provider/supplier will also lead investigations into complaints made about any aspect of Children’s Social Care Services and potentially on occasion in Adult Social Care statutory complaints investigations and corporate complaints.
The latest tender was through the Open ITT procurement/ tender process - Yortender Ref: 78783 (the then current contract ref was DN352983)- with support, advice and guidance from the procurement and legal teams including updating the specification and the contract terms etc. There was a check done on whether this needed to go to the Procurement Challenge Board, but it did not need to be submitted and considered by that Board.
There had been an extension of the then current contract for a further 2 years in 2021 with advice and guidance from procurement and legal including what had to be done to meet the then Council’s Contract Procedure Rules CPR 19.1.2 – “The Chief Procurement Officer and Legal Services should be consulted in relation to any proposed extensions”. Eg evidencing why the extension of this contract was required, how it represented Value for Money to the Council and how it supports the Council delivery of its statutory obligations. That evidence was then submitted to procurement who then took it to the Council’s Chief Finance Officer and Legal Services to be considered. The extension was approved.
The new contract value was put at £50k p.a. with the intention of awarding a 3 years + extension of up to a further 2 years (5 years) which is a total contract value of £250k.
The contract awarded is for 3 years with an option to extend for a further 2 years so total possible contract duration of 5 years.
September 2023 – OTT procurement 18/04/2024 – contract signed by successful provider 23/04/2024 – contract signed by Director
Although the contract was due to be “signed” in January 2024, due to queries raised through the procurement process, the procurement was not completed and the contract signed in April 2024.
