Purpose:

Purpose of Report: For the Council to implement the requirements of the EU Service Directive. The Cabinet Member for Homes and Safer Communities is asked to approve the Council implementation of the EU Service Directive.

 

Due to the recent change in Cabinet Member responsibilities, this decision will now be taken during May.

 

This decision will now be made during June to allow for amendments to the report.

 

This decision will now be made during July as further work is required.

 

This decision will now be made during September as further work is required to understand the impact.

 

Decision:

Resolved:           That the Cabinet Member agreed the list of permissions, licences and consents where tacit authorisations should be disapplied.

 

Reason:              The Directive assumes that all permissions licences and consents will have a pre-published determination period, where an application is not determined within a timeframe it is granted by default. This is known as ‘tacit authorisation’. There is a mechanism whereby a permission, licence or consent can have ‘tacit authorisation’ disapplied if there is an overriding reason to do so in public interest.
