This decision is to support the proposal for
City of York Council to become a local authority partner, with the
Foundations Independent living Trust (“FILT”), to
enable the piloting of the administration of the Health Through
Warmth Scheme in 2023/2024 in York.
This decision is also to authorise the Head of Housing Delivery and
Asset Management, in consultation with legal services and the
information governance, to negotiate the provisions, and conclude
the entry into the proposed Service Level Agreement and Data
Sharing Agreement with FILT.

March 2023 Executive Decision Session gave
authority to progress to deliver the scheme on a phased basis
commencing with the higher priority affordable items (lighting
& CCTV) and undertake further development work within the
current budget.
The scope of works is included within the contract. It is to be
noted the scheme has been successful in receiving funding from
Active Travel Grant Fund.

To give authority to enter into contract to provide Preliminary
Design for the scheme.
To appoint AECOM as a direct award via the Pagabo Professional
Services Framework under Lot 2 Civil Engineering. This framework is
fully compliant with all UK and EU procurement law and the
framework has published a compliant OJEU notice (Reference: 2020/S
079-187629).

Decision:
York has been allocated £5.1m from the
UK Shared Prosperity Fund (UKSPF) to implement the investment plan
that was agreed by DLUHC in January 2023. In October 2022, CYC
Executive gave delegated authority to the Corporate Director of
Place to implement this Investment Plan, in consultation with the
relevant Executive Members and the York UKSPF Partnership
Board.
York’s UKSPF Partnership Board considered that the need to
provide sound advice to residents on how to reduce their energy
bills through efficiency measures has been heighted and decided to
allocate £118,200 to York Community Energy (YCE) in the SPF
Investment Plan, under the intervention ‘community measures
to reduce the cost of living’. YCE provide free energy advice
and support to York households, along with installing energy-saving
measures to those on low incomes, aged 65 or over or experiencing
long-term physical or mental health conditions.
YCE received funding to carry out activities within the 22/23
financial year, with an underspend enabling them to carry on
activities in their second year of delivery. Second- and third-year
funding was paused until after the May 2023 local elections, and
the York SPF Partnership Board and Executive Member have since
indicated that they wish to continue with this project. CYC
officers have worked to ensure that this project with YCE works in
conjunction with DESNZ Local Energy Advice Demonstrator (LEAD)
project, which focuses on conservation areas and traveller sites in
York, so that support to residents to take-up energy efficiency
measures is maximized. The decision concerns the release the
remaining UKSPF funding to YCE.
Decision: To allocate a total of £118,200 to York Community
Energy for York SPF intervention E13.

New Year’s Eve hours shall be extended from the end of permitted hours on New Year’s Eve until the start of permitted hours on New Year’s Day. For statutory bank holiday weekend periods (Friday, Saturday, Sunday and Monday) and for the Thursday before Good Friday and for Christmas Eve, the finish time will be extended by one hour beyond these times. |
The conditions agreed between the Applicant and North Yorkshire Police set out in Annexe 3 of the agenda and the conditions agreed between the Applicant and Public Protection numbered 1, 2, 4 and 5 as set out in Annexe 4 of the agenda shall be added to the licence.
The following conditions shall also be added to the licence:
- No bottles, glasses or similar items may be disposed of in outside receptacles between 20:00 and 08:00 hours.
- A direct telephone number for the manager on duty at the premises and an email address for the area manager shall be made available via letter every 6 months to the residents of Lady Hewley Cottages, St Saviourgate and Stonebow House.
- The number of customers permitted in the premises at any one time shall not exceed 400 customers.
The conditions contained in the Operating Schedule shall be added to the licence unless contradictory to the above conditions.
The licence is also subject to the mandatory conditions applicable to licensed premises.

Purpose of the Report: To update on the Additional Licensing
Programme for Houses in Multiple Occupation. It will seek approval
to further support tenants in unlicensed Houses in Multiple
Occupation to meet our ambition of increasing the quality and
standard of private rented houses in the city.

i. That the creation of a partnership with Justice for Tenants (JFT), who could provide support and advice to private residential be supported, including applying for rent repayment orders, through the signing of a Service Level Agreement and Data Sharing Agreement between the Council and JFT.
ii. That authority be delegated to the Director of Housing Economy and (and their delegated officers), in consultation with the Director of Governance (and their delegated officers), to negotiate the provisions, and conclude the entry into the proposed Service Level Agreement and Data Sharing Agreement with JFT.
Reason: The proposed partnership will assist the Council in bringing private sector properties, and in particular properties which are subject to additional HMO licensing requirements, into compliance with legislation by encouraging tenants to report properties which are non-compliant to the Healthy and Sustainable Homes team to investigate and take appropriate action to resolve.
