Definitive Map Modification Order Application to record a public footpath between Chantry Lane, Bishopthorpe and Acaster Malbis 3

Decision Maker: Decision Session - Executive Member for Transport - Expired, Executive Member for Transport

Decision status: Decision Made

Is Key decision?: No

Is subject to call in?: Yes

Purpose:

Purpose of report: For the Executive Member to consider evidence submitted in support of a DMMO application to add a footpath to the definitive map in the Ward and Parish of Bishopthorpe and to determine whether or not to authorise the making of an order under the Wildlife and Countryside Act 1981.

The Executive Member will be asked to either authorise the making of the DMMO to record the footpath on the definitive map and statement, or not.

Decision:

Resolved: That, in accordance with Option A:

(i)           The making of a DMMO to record the route from Ferry Lane to Acaster Malbis 3 (B to C to D), as shown on the map at Appendix 2, as a public footpath, be approved.

Reason:     The available evidence meets the statutory test of reasonably alleging that a public right of way subsists over the land affected by B to C to D.

(ii)          The 2006 application be rejected and the applicant informed of their right to appeal.

Reason:     The application was not duly made and relates only to the consecrated land (A-B).
