Decision details

Public Rights of Way – Proposal to restrict public rights over the alleyway between Brunswick Street/South Bank Avenue, Micklegate Ward, using Public Spaces Protection Order legislation

Decision Maker: Decision Session - Executive Member for Transport - Expired

Decision status: Decision Made

Is Key decision?: No

Is subject to call in?: Yes

Purpose:

Purpose of Report: To outline the need to make a decision as to whether or not to seal and make operative the Draft Public Spaces Protection Orders.

The Executive Member is requested to agree with the officer recommendation to not make operative both schemes.

Due to the volume of data involved, this issue has been split and renamed from Public  Rights of Way - Proposal to restrict public rights over the following alleyways using Public Spaces Protection Order legislation; Curzon Terrace Alleyways and Burnswick Street/South Bank Avenue (both Micklegate Ward) to Public Rights of Way – Proposal to restrict public rights over the alleyway between Brunswick Street/South Bank Avenue, Micklegate Ward, using Public Spaces Protection Order legislation.

Curzon Terrace Alleyways will receive its own report.

Decision:

Resolved:  That the Executive Member agrees not to seal the Public Spaces Protection Order to restrict public rights over the alleyway between Brunswick Street/South Bank Avenue in the Micklegate Ward.

Reason:    The nature of the objections received would suggest that this scheme would not be appropriate for this area.  Previous consultations for this alleyway have found that residents are not in favour of alley gating, and the results of this consultation reflect this. The complicated layout of this alleyway and the waste collection changes that would be required, lead officers to recommend that this scheme would not be appropriate.
