Decision details

Executive in April 2026 agreed to formally initiate a new Local Plan. The detail of the formal notification was delegated to the Director of City Development. As per the decision to proceed with a timetable to trigger the formal plan-making process (passing through Gateway 1) in October 2026, formal notification was agreed on 25 June 2026 via officer decision. This notification was published on the Council website on 26 June 2026 to comply with the requirements of The Town and Country Planning (Local Planning) (England) Regulations 2026 and planning guidance issued by MHCLG. Alongside this a data-compliant timetable was uploaded onto York Open Data as per the regulations.

It had been intended that CYC would work with North Yorkshire Council (NYC) and North York Moors National Park Authority (NYMNPA) to review the Minerals and Waste Joint Plan (MWJP). The MWJP was adopted in April 2022 and therefore, under the new Regulations, formal commencement of the review of the MWJP must take place by December 2026. Initial officer discussions between the authorities indicated a continued preference for joint working. The MWJP was previously prepared jointly to reflect the functional geography of minerals extraction and waste management across York and North Yorkshire. This approach has enabled the pooling of evidence, shared use of resources and alignment with established patterns of infrastructure and service delivery.

Subsequently a decision on 29 June 2026 by the NYMNPA to progress a new Local Plan incorporating Minerals and Waste policies, has triggered reconsideration of progression of a MWJP.

As a result of the decision of NYMNPA we now intend to include Minerals and Waste policies within our Local Plan and a decision was taken at Executive Member Decision Session on 30 July to approve this approach pending formal confirmation at a subsequent Executive meeting in the autumn.

Regulation19(4) of the Town and Country Planning (Local Planning) (England) Regulations 2026 is clear that where a local planning authority are the minerals and waste planning authority for any part of their area and their Local Plan is to incorporate all or part of their minerals and waste their notice of intention to commence Local Plan preparation must specify this.

Our initial notification did not include reference to minerals and waste policies as we had intended to progress a MWJP at the point notification was made. Planning guidance issued by MHCLG also clarifies that you must issue a new notification if you need to restart the plan preparation process, including where you were working on a joint plan and the other local planning authorities you’re working with change. As a result we now need to issue an amended notification to address these changes. This document is attached at Annex A.

The Regulations are also clear that there must be a minimum of 4 months between notification and Gateway 1. Our current timetable indicates that we will meet Gateway 1 in October 2026, which will no longer be possible given that notification is taking place in July 2026. Amendments have therefore been made to the Local Plan timetable to meet the Regulations. Annex B provides a data-compliant timetable to upload onto York Open Data as per the Regulations.
