Background:
In the past, the rights of way network has been changed by public path diversion, creation and extinguishment orders made under either the Highways Act or the Town and Country Planning Act. Other changes to the network have been made as part of Section 38 Highways Act adoption processes and many other Act that have the power to divert, create and stop up public highways. However, these orders do not have the power to change the definitive map (the official record of the rights of way) although they have changed the affected right of way on the ground.

In order to complete this process and ensure the definitive map (the legally conclusive record of public rights of way) is accurate it is part of the council’s statutory duty to make legal event modification orders (LEMO). These LEMOs update the definitive map so that it reflects the changes made to the rights of way network by other orders.

The list below lists the changes made under various other Acts and process followed for those orders included consultation with the public and stake holders as required by the specific Acts. A separate LEMO for each order is then needed to change the definitive map.

City of York Council has never made LEMOs for the former North Riding area hence the LEMOs below date back to the relevant date of 1956 for the former North Riding Definitive Map. Making LEMOs is an internal, administrative task that incurs no additional expense or consultation process.
