Consultation process
Officers have taken legal advice to confirm
whether the proposed amendments fall with the legal framework, in
this case the Planning and Compulsory Purchase Act 2004 which
provides the statutory framework for Local Plan preparation and
modification (see s23(3)(b)). The Act does not define
‘non-material’ in relation to Local Plan corrections
post modifications however there is relevant case law.
